2. What a valid notice must include
Your written notice should include:
- Identification of the copyrighted work claimed to be infringed.
- Identification of the material claimed to be infringing, with enough detail for us to locate it (URL or title and author).
- Your contact information (name, address, telephone, email).
- A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notice is accurate, and under penalty of perjury that you are authorized to act on behalf of the copyright owner.
- Your physical or electronic signature.
3. Our process
Upon receiving a substantially compliant notice, we will promptly remove or disable access to the identified material and take reasonable steps to notify the user who posted it. We may ask for clarifying information if a notice is incomplete.
4. Counter-notice
If your material was removed and you believe the removal was a mistake or misidentification, you may send a counter-notice to the same agent including:
- Identification of the material removed and where it appeared before removal.
- A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for your address (or any judicial district where Ndotonic may be found if outside the U.S.), and that you will accept service of process from the person who filed the original notice.
- Your physical or electronic signature.
If we receive a valid counter-notice, we may restore the material in about 10–14 business days unless the original complainant notifies us that they have filed a court action seeking to restrain the alleged infringement.
5. Repeat infringers
It is our policy to terminate, in appropriate circumstances, accounts of users who are repeat infringers. We may also suspend accounts earlier for clear, willful, or high-volume abuse. We keep records of notices and enforcement actions as needed to operate this policy.
6. Misrepresentations
Knowingly misrepresenting that material is infringing, or that material was removed by mistake, may expose you to liability for damages, including costs and attorneys’ fees.
